good afternoon, i'm michelle griego. >> hi, everyone. i'm frank mallicoat. it was one of the wettest weeks in memory in the bay area. the storm has finally cleared. good news there. but some of its lasting effects are still being dealt with today like this one a massive sinkhole. it's a major road hazard in lafayette. and that's where cbs 5 reporter elissa harrington is with it's going to take to clean it up. >> reporter: the city has a huge project on its hands. the city manager said this is the largest sinkhole he hasstein in more than 20 years and going to take a lot of time and money to fix it. a big problem in one lafayette neighborhood a 20-foot sinkhole swallowing a section of mountain view drive near downtown. chris lives steps away in this blue house. the sinkhole is practically in

his front yard goosiery. sounded like a big crushing -- crumbling in. >> reporter: the sinkhole opened up yesterday after heavy rain. the creek under the street was running high with debris. >> it plugged the talbot, goes under the road, the water had nowhere to go and so it eroded the road around the culvert and collapsed the road. >> reporter: neighbors can't believe it. >> absolutely amazing. never seen anything like this in my life, never dreamed of it. by knew the area flooded on -- we knew the area flooded on new year's in 1977 but never saw this before. >> i have never seen this happen before. right in front of my house, it's like wow. >> reporter: the city has big tasks on its hands, first securing utilities. water, sewage and gas lines are under the road. a few homes are without water while east bay m.u.d. secures the line. next clean-up. excavators are used to clear

debris. also road closures. detours are in place and no residents will be isolated. finally, coming up with a plan to fix that hole. >> it takes some really solid civil engineering and then a lot of money. >> reporter: any idea on the number? >> no idea. i'm -- i'm betting it will be in the 6 figures. >> reporter: it will be a while before this road reopens. i spoke with one of the contractors and he told me it can take months before that sinkhole is repaired. in lafayette, elissa harrington, cbs 5. this was the russian river in guerneville where residents were cautiously watching water levels rise there. the river peaked at 27.5 feet this morning, 5 feet under flood stage. the highest recorded flooding in guerneville occurred back in 1986 when the river reached 49 feet. a marin county school suffered significant flooding from the weekend storm. classes at white hill middle school in fairfax are canceled today while crews clear rainwater and mud from classrooms, offices and even

the library. school administrators will meet later today to discuss whether class will resume tomorrow. it wasn't just rain that caused problems. strong winds knocked down power lines all over the bay area leaving hundreds of thousands without power. pg&e worked through the night restore most of the power lines but some people may have to wait until tomorrow morning until they get power. right now about 2600 customers are still without power. highway patrol car flipped over in livermore during a chase that reached 90 miles per hour. it happened just before 3:30 this morning eastbound 580 between greenville and north flynn road. other officers caught one that car in tracy and took the driver into custody. two officers in the car that overturned had minor injuries. a member of the coast guard is dead after his boat was rammed off the coast of southern california. the guard was there investigating suspected smuggling near the channel islands just off santa barbara. during the investigation, a small guard boat was hit by a

smuggler's vessel on sunday. two members of the guard were thrown into the apartment. one was killed, the other had minor injuries. tensions are rising in syria after intelligence official in washington, d.c. reported movement of chemical weapons components in the country in recent days. syria will not confirm if it has chemical weapons. but it is adamant that if it does it would not use them on its people. meanwhile, violence near the airport in damascus forced the flights of egypt to turn back today and the u.n. announced a short time ago it's pulling out all its nonessential staff from the country amid security concerns. an appeals court is hearing the case of former bart police officer who killed an unarmed man in 2009. officer johannes mehserle appealed his conviction in the death of oscar grant. grant was detained by bart police during an altercation was shot and killed. mehserle already served his two- year prison term for involuntary manslaughter but

wants to clear his name. lawyers for grant's family will argue against overturning the conviction. the high court delays a decision whether it will review the case of prop 8, california's ban on same-sex marriage. >> cbs 5 reporter cate caugiran spoke with legal experts today so, cate, what's the delay mean? >> reporter: the supreme court's next conference to consider pending appeals will be this friday. and legal experts told me that pushing this decision back really will have no difference in the grand scheme of things. >> it's like well we have so many cases on the docket let's put it off until next week. no big deal. that's what happened. it's the dog that didn't bark. it's a case that hasn't been resolved yet and we're waiting. >> reporter: this began when supporters of prop 8 appealed the ninth u.s. circuit court of appeals in san francisco's decision to declare the measure unconstitutional. >> the court has been waiting to gather all ten of these cases together and then they are going to make some kind of decision, either grant review

in some of them or all of them or none of them. they could do anything. >> reporter: cbs 5 legal expert rory little says the delay means nothing in the eyes of the court. the timeline for the appeals process will still play out the same. >> if they grant review in any of these cases, next friday, there will then be an argument scheduled sometime in march probably, possibly april. and the case will be decided by the end of june. >> reporter: if the court denies review, we could see changeses early as two weeks from now. the case will come back to the ninth circuit. once a mandate is filed, then same-sex marriage license can be issued. if they grant review, the status quo is maintained until the appeals process plays out. professor little says he expects if the court grants review, we will know friday but if the court decides to deny or postpone the review, that announcement will come later. live in the newsroom, cate caugiran, back to you. >> thank you. meanwhile in washington,

democrats and republicans appear nowhere near a compromise to avoid the "fiscal cliff." the deadline is at the end of the month but lawmakers may only have a couple of weeks to get a deal done. danielle nottingham reports now from washington. >> reporter: washington is driving toward the "fiscal cliff" and with just 29 days left, negotiations are at a stalemate. >> right now i would say we're nowhere. >> reporter: taxes continue to be the line in the sand between democrats and republicans. >> there is no path to an agreement that does not involve republicans acknowledging that rates have to go up for the wealthiest. >> reporter: gop lawmakers don't want higher rates and say the obama administration's proposed cuts to entitlements don't go far enough. >> i think we're going over the cliff. it's pretty clear to me they have made a political calculation. this offer doesn't remotely deal with entitlement reform in a way to save medicare and medicaid and social security from bankruptcy. >> reporter: if a deal is not

reached, taxes go up and spending will be clashed. defense contractors are sending the message to lawmakers those cuts would damage the military industry and weaken national security. the ceo of task, a company that develops aviation systems and software for intelligence agencies: >> over 50% of the defense budget is procuring services and services are underscored by jobs. so of course there will be job loss if you have cuts. >> reporter: the cliff hits at the end of the year. but congressional leaders say a compromise needs to be figured out in the next couple of weeks so lawmakers have enough time to debate and pass it. in washington, danielle nottingham, cbs 5. so if democrats and republicans do not reach a deal, the tax policy center estimates the average american will have to pay nearly $3,500 more in taxes next year. still ahead, there's a royal bun in the oven. but things aren't going so well for the duchess of cambridge.

the mammals grabs a girl's arm instead of the fish. welcome back, everybody. the 8-year-old was with her family in orlando when it happened. her father was recording at the moment with his cell phone. his daughter jillian is among dozens of people feeding the dolphins. she picked up an empty paper plate to say she is finished and the animal jumped out of the water and bit her on the arm. >> i accidentally held it up, the dolphin jumped up and ate the carton and bit my hand. >> they told to us keep the paper plate on the wall. we didn't know why. we didn't sign a disclaimer. there was no signs on the wall that says, the dolphin could bite your hand or there is a level of risk in this attraction. >> they posted the video to warn other plans and the family doesn't plan legal action. seaworld says it's taking the incident seriously. could have been worse. >> no kidding. it's the news royal fans

have been waiting for since the marriage of william and kate. they are expecting a baby. but tina crouse reports there are problems for the mother-to- be. >> reporter: palace officials confirm the duchess of cambridge is almost 12 weeks pregnant but it hasn't stopped her from keeping up her royal appearances. just days ago, she was playing hockey in heels at her former elementary school. last week, the duke and duchess received their first baby gift on a visit to cambridge. will and kate have made no secret of their desire to start a family even before their royal wedding, a year and a half ago. palace officials revealed the news after kate was taken to the hospital for a severe form of morning sickness. doctors say her condition is rare but treatable. >> really severely dehydrate you and a lot of weight loss can be associated with that. so the best thing to do with it is to get fluids back into your body. >> reporter: there's been a lot of speculation about a royal

nontop shopping starting yesterday through christmas eve. it's the latest evident by a retailer to squeeze every last dollar out of a shaking economy. new boots became an instant online hit but today a homeless new york city man is back on the streets and barefoot. the "new york times" found the man identified as jeffrey hillman wandering barefoot in manhattan last night. when asked about the $100 boots that a new york city officer was seen giving him, hillman said he had hit them because they are worth a lot of money. hillman told the reporter he was grateful for the gift but was also wants a piece of the pie apparently saying the photo of him receiving the boots was posted online without his permission. it was an arizona tourist who witnessed the gift-giving. her photo went viral after it was posted on facebook. so... he wants a piece of the pie. >> i guess. what does that mean? >> he got boots. he should be happy with that. let's check the weather. >> we can relax for a day after stormy weather around the bay area. we are catching a break between

all those storms and we can use it. you know what, hi-def doppler has been very busy but right now very quiet as there are no raindrops on the screen right now. somewhat unusual compared to what we have had over the past few days. over the bay looking good but what a series of storms we had. get a load of some of these totals since wednesday. we have had almost 16" of rain in venado in the north bay. mount umunum where the national weather service radar is located almost 16." santa rosa almost8" of rain, 4" in san francisco, 4.67" in concord. the russian river near guerneville this morning topped off at about 27 feet. that's below flood stage. it continues to recede. we are looking at a nice afternoon. get out there and join it. some sunshine out there dry conditions temperatures should be mainly in the 60s tonight. the clouds are going to thicken up a bit once again as we have

a storm system approaching the coastline. overnight lows in the 40s and the 50s. and well looks like a nice afternoon around the bay area. 59 degrees right now in san jose. 61 in the napa valley and 56 degrees in san francisco. there are changes coming though. high pressure off the coastline but only giving's brief break. look at this. we have yet another storm that's approaching the bay area. so enjoy the break today. looks like tomorrow we get back into it again. some rain developing maybe as early as the latter part of the afternoon in parts of the north bay. most of it comes through tuesday night into wednesday morning. this storm system doesn't look as windy and wet. maybe one to two inches of rain instead every five to eight inches from the last couple of storms. thursday things dry out and that means better weather ahead but we still have that storm to deal with. today 65 degrees in san jose. 46 degrees in redwood city. east bay -- 64 degrees in redwood city. east bay temperatures in the 60s, as well. you will see 60s inside the bay. the next couple of days we'll

ovarian cancer. a mayo clinc study found diabetic patiens with common diabetes drug may increase survival rates among women with ovarian cancer. a mayo clinic study found diabetics patients with ovarian cancer took the drug for the diabetes for nearly four times more likely to survive compared it cancer patients who did not take the drug. previous research on the drug has shown it may also fight other cancers. researchers hope to start using the drug for large-scale trials with people with ovarian cancer. here's a link you may not have expected. researchers say your tap water may be to blame for your food allergies. scientists have found that a chemical used in pesticides and tap batter chlorination is linked to low tolerance of certain foods. food allergies affect 15 million people in the united states. tangerines are on tap for tony tantillo today. he shows us everything we need to know about picking out the best tasting tangerines. >> reporter: well, today's tip of the day is going to be is
